Debonairs Pizza – FRIENDZY™ Promotional Campaign

Terms and Conditions

  1.  :
    1. All persons (“Participants”) entering the Debonairs Pizza – FRIENDZY™ Promotional Campaign  (“Promotion”) agree that the promotion rules as set out in these terms and conditions (“Terms and Conditions”) are binding to them.
    2. The promoter of the campaign is Debonairs Pizza Limited (“the Promoter”).
    3. TLC Marketing Worldwide PTY (LTD) (registration number: 2010/011691/07), a private company duly incorporated in accordance with the laws of the Republic of South Africa with its registered address at 1st Floor, Block F, 150 Linden Road, Strathavon, Sandton, 2196 (“TLC”), is the agent of the Promoter for this Promotion.
    4. Any person who is under the ageof 18 (eighteen) years (“a minor”) must obtain their parent or legal guardian's consent, in order to enter and qualify as a Participant for the Promotion (together referred to as “Participants/Entrants”).
    5. Directors, and agents of the promoter, their immediate families, life partners, business associates, any advertising agencies of the promoter, their printers, their marketing suppliers and their family members and any person directly involved with the deriving, production, management or marketing of this Promotion (“Excluded Persons”) are not eligible to participate in nor enter into the draw(s) for the Grand Prizes. Excluded Persons may however participate and receive any of the Instant Rewards.”
    6. This Promotion offer runs from 11 June2019 to 12 August 2019 while reward sticker stocks last and the last redemption date will be 23 August 2019 after which date the promotion will automatically lapse.
  1. Entry Process
    1. To participate or enter the Promotion, Participants must purchase a large pizza from our main menu, including speciality pizza (excluding the Large Real Deal, On the Double® and On theTriple® pizzas) and follow the instructions on the promotional pack to receive their reward.
  1. Nature of the Reward Services
    1. These terms and conditions are applicable to:
      • The Participants qualifying criteria;
      • The terms and conditions applicable to the qualifying account or service;
      • The Rewards Services (“Rewards”) which are sourced from third parties; and
      • Each reward redeemable during the subsistence of this Promotion.
    2. By entering or participating and/or redeeming the reward(s) in this Promotion, you agree to be bound by these terms and conditions.
    3. All reward vouchers are valid for 1 month from date of receipt by Participants.
    4. Each Participant hereby gives consent to the Promoter to process their personal information to third parties for the purposes of this Promotion.
  1. Instant Rewards

    Participants can win their share of R160 million, within our pool of 3 300 000 instant reward stickers, which have been allocated to this promotion, distributed amongst participating Debonairs Pizza restaurants.

    The qualifying participants will receive a sticker with a unique code on their large pizza box and they will be entitled to an instant reward randomly drawn from a selection of different vouchers once they submit the code found on their sticker.

  1. How to claim your reward
    1. Participants who purchase any large Debonairs Pizza (excluding the Large Real Deal, On the Double® and On theTriple® pizzas) within the promotional period will receive a peel and reveal sticker containing a unique code and instructions to claim their reward, while stocks last.
    2. The participant will be required to follow the USSD journey by dialing *120*6269# and entering their unique code and some personal information before they receive their instant reward.
    3. Once the Participant is successfully validated, he/she will be required to enter his/her contact information
    4. The Participant will also be asked whether they consent to receive marketing from Debonairs Pizza or not.
    5. The Participant will receive their reward and redemption information via SMS.
    6. Instant rewards are randomly selected and sent to participants.

      • Bookings need to be made within 1 month from redemption, travel dates will be available for bookings of up to 6 months from redemption.

  1. Grand Prize Terms and Conditions

    Prize Draws will take place on a weekly basis over the campaign period

  1. 1 x Island Holiday
    • There is 1 (one) Grand Prize travel packages to the Mauritius or Zanzibar dependent on the promotional availability and discretion of the Promoter.
    • Return flights for 2 adults or 2 adults and 2 children under the age of 12, on an economy class flight and airline of the Promoters’ choice, from South Africa to the specified destination; from an international airport in South Africa (closest to where the winner resides). The Winner is responsible for transport arrangements to and from her/his residence to the closest South African international airport – for herself/himself and her/his partner;
    • 5 (Five) nights’ hotel accommodation whereby the couple (winner and partner or children) will share.
    • a standard hotel room of the Promoters’ choice; on full or half board.
    • The hotel room will be furnished with a double bed (note that the Promoters cannot guarantee the option or possibility of a twin room);
    • The Promoters will conduct 2 (two) random draws, from the total list of valid entries received to determine the possible Grand Prize winners.
    • The Grand Prize draw will take place on 27 August 2019.
    • Potential winners will be contacted within 3 (three) working days from draw and will be requested to provide the relevant documentation in compliance with these Terms in order to claim the Grand Prize.
    • The Promoters will contact the potential winners on the mobile number used to submit the winning entry into the promotion and will conduct an audit/verification process of the selected winning entry. Winners will be announced by 1 September 2019.
    • Together with a copy of the participant’s Identity Document and proof of residency, and a passport copy of the possible winner and partner that is valid for at least 6 months from August 2019. In other words, valid at least until February 2020,
    • Participants’ passports must have at least 2 (two) blank pages in order for a possible winner’s particular entry to be confirmed as valid.
    • Should the potential winners or their chosen partners be unable for any reason whatsoever to supply the Promoters with all the necessary documents needed for a travel documents or in compliance with any other requirement contained in these Terms, within 3 (three) days of being confirmed as the Grand Prize winner, the winner will be automatically deemed to have forfeited the Grand Prize.
    • Winners and partners must be over the age of 18 (eighteen) years and be able to confirm that they can travel within the travel dates of the Grand Prize stipulated above. Children must be under the age of 12.
    • The Promoters will not be responsible for any other expenses which the winner and/or partner(s) may incur as a result of their acceptance and/or use of any Prize and/or Grand Prize, whether foreseen or not.
    • Participants whose entries have been drawn and have been confirmed as valid after the verification process, must be able to travel during 1 October 2019 to 15 November 2019 and 15 January 2020 to 31 March 2020 (“Travel Date”), in order to qualify to be declared a winner, failing which the Promoters shall randomly draw another entry in the same manner as the first.
    • Should the potential winner and/or partner(s) not have a valid passport with 2 blank pages, or be unable to travel for any reason whatsoever or use the Grand Prize on the Travel Date(s) determined by Promoters, then likewise the winner will be deemed to have forfeited the Grand Prize.
    • Travel and hotel reservations are subject to availability and may not be available on certain dates, and accordingly Travel Date(s) may be varied and any or all amendments of travel dates will be at the Promoters’ discretion.
    • Promoters shall not be responsible for any changes, substitution, withdrawal, cancellation or postponement of any part of the Travel package/itinerary/games beyond its reasonable control. Promoters are not obliged to award any other Prizes or elements of the Grand Prize, in lieu if any such event is cancelled, postponed, substituted, withdrawn, changed or unavailable for a reason beyond the Promoters’ control.
  2. 9 x Smart TV’s
    • 1 (one) of 9 (nine) Smart TV’s of the Promoters’ choice.
    • The winner must be in possession of a valid South African television license and must be able to produce proof of such at collection / delivery of the prize.
    • The annual South African television licence fee will be the sole responsibility of the winner.
  3. Fiat Tipo Sedan 1.4 and R5000 Fuel Voucher Giveaway
    • Participants stand a chance of winning 1 (one) Vehicle Prize.
    • To claim the Vehicle Prize, the Winner must produce their valid South African driver’s license or valid South African driving permit.
    • The Promoter will call the potential finalists on the cell phone number used to enter the promotion. The potential finalist will be called once a day for 3 (three) days and if the Promoter is not able to contact the possible finalist during this time, the Promoter will move onto the next possible winner.
    • The possible winner will need to be verified and provide the Promoter with a certified copy of their South African ID/or Passport with their endorsed residences permit and South African driver’s license and complete a finalist form. Blurred or obscured copies will result in disqualification. The requested documents need to be sent within 48 (forty-eight four) hours if not done the finalist will be disqualified and the Promoter will move onto the next possible finalist.
    • If the possible finalist passes the verification the Promoter will declare the required documents stipulated in rule above as the Winner. (The validity of such documentation is at the Promoter’s discretion.)
    • In the instance that the winner is not in possession of a valid South African Driver’s license, that winner will be disqualified, and the Promoter will choose another winner from the finalist.
    • The Vehicle Prize will be delivered to a dealership closest the winner’s address provided to the Promoter. The Promoter will advise the winner when the Vehicle Prize will be ready for collection in September 2019.
    • If the Winner does not take delivery of the Vehicle Prize within 21 (twenty one) working days and does not provide an updated expected date and time for delivery, then the Winner will forfeit the Vehicle Prize, and the Promoter will move onto the next possible finalist.
    • The Vehicle Prize cannot be exchanged for any other model or make within the vehicle range and the winner does not have the right to change the colour and/or specs of the vehicle.
    • The vehicle prize is not transferrable and not exchangeable for cash.
    • The winner will need to arrange insurance prior to taking delivery of the Vehicle prize. Proof of insurance will need to be submitted to the Promoter prior to the winner collection the vehicle.
    • All registration and licencing costs will be the winners responsibility and for the winners account. All fees applicable will need to be paid for prior to taking delivery of the Vehicle Prize.
    • The Vehicle Prize does not include any extras such additional accessories.
    • The Fuel voucher entitles the winner to R500 worth of fuel from any Engen nationwide for 10 months (R 500 per month.)
    • The promoter reserves the right to change the vehicle model to another vehicle at the same value, if the vehicle advertised is no longer available.
    • No liability shall attach to the Promoter in relation to any claims, losses or liabilities for any loss of profit or any other direct and/or indirect, special or consequential loss arising out of any of the Prizes. The Promoter is not liable for any defects in the Prizes. Ownership of and risk in, and benefit attaching to, the Prizes will pass to the Winner immediately.
    • All Prizes are awarded at the discretion of the Promoter. The Promoter reserves the right, at its own discretion, to substitute a Prize with any other Prize of comparable commercial value or an appropriate replacement value in the place of the Prize.
    • The Vehicle Prize can only be awarded to the winning finalist that has not won in any competition organized by the Promoter within the last 6 (six) months.
  1. General
    1. All REWARDS are only redeemable in South Africa.
    2. All REWARDS are selected via an automatic system and cannot be exchanged for a different REWARD.
    3. TLC partners’ terms and conditions apply to each REWARD.
    4. The REWARDS are strictly subject to the availability of the participating TLC partner
    5. REWARDS cannot be redeemed for cash in part or whole and are non-refundable and non-exchangeable.
    6. Should the REWARD not be utilized for whatever reason, it will be forfeited. No negotiations will be entered into.
    7. All participants indemnify the promoter, their advertising agencies, advisors, suppliers, nominated agents and dealers against any and all claims arising however including willful misconduct, negligent act or omission from their participation in the promotion.
    8. The promoter, its advertising agencies, advisors, suppliers, nominated agents and dealers accept no responsibility and will not in any circumstances be responsible or liable to compensate any participants, or accept any liability for:
      • any inability by a participant to correctly use or non-use of the TLC benefits; or
      • The lack of quality of rewards or any other aspect of any service, which is or should be provided at any venue(s), nor will any of them be liable for any personal loss or injury occurring at any venue(s).
    9. The promoter, it advertising agencies, advisors, suppliers, nominated agents and dealers are not responsible for any REWARD misrepresentation (written or verbal) on warranties made by anyone/group.
    10. The promoter, its associate companies, agents, contractors, sponsors and distributors do not guarantee the quality and/or availability of the services/rewards offered by the TLC partners and assume no liability whether direct or indirect loss or damage arising from a participants participation in the promotion, or of any loss howsoever arising.
    11. The promoter and/or its agent shall at any time have the discretion to alter or terminate any aspect of this REWARDS Promotion.
    12. If the promoter is required by the Minister of Trade and Industry or the National Lotteries Board to alter any aspect of this promotion or to terminate the promotion as a result of changes in legislation, the promoter will have the right to terminate this promotion with immediate effect and without notice of such termination. In such event, all participants hereby waive any rights which they may have against the promoter, its agents, contractor and/or employees.
    13. The Promoter and/or its agent reserves the right to vary these terms should the need arise.
  1. Exclusions and other important terms
    1. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either you or the Promoter and it’s agent in terms of the Consumer Protection Act, 68 of 2008 ("CPA").
    2. You access the REWARDS entirely at your own risk. By reading and accepting these Terms and Conditions, you give consent to these risks and hereby indemnify and hold harmless the promoter, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of your redemption of the benefits and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or willful misconduct of any of the indemnified parties.
    3. The Promoter and/or its agent reserves the right to terminate the benefits at any time. In the event of such termination, you agree to waive any rights that you may have in terms of the benefits and acknowledge that you will have no recourse against the promoter and/or TLC Marketing Worldwide, its advertising agencies, advisers, suppliers and nominated agents.
    4. By accessing these REWARDS in accordance with its terms, you acknowledge that the REWARD will be managed in accordance with the provisions of the CPA. You undertake to expeditiously do all things necessary to enable TLC Marketing Worldwide to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the REWARD.
